Welcome to Bohotides. By accessing this website or completing a reservation, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions in full. If you do not agree, do not use this website or make a booking.

1. Definitions

"Bohotides," "we," "us," and "our" refer to Bohotides LLC, a family-operated short-term rental business based in San Diego, California.

"Guest," "you," and "your" refer to any person accessing this website, making a reservation, or occupying a Property.

"Registered Guests" refers to all individuals listed on a confirmed booking.

"Unauthorized Occupants" refers to any person present at a Property who is not listed on the booking.

"Property" refers to any short-term rental unit owned or managed by Bohotides LLC.

"Booking" refers to a confirmed reservation made through this website or any affiliated platform.

2. Use of This Website

You may use this website for lawful purposes only. You agree not to:

- Reproduce, copy, or redistribute any content from this website without prior written permission

- Use this site to engage in fraudulent, misleading, or unlawful activity

- Attempt to gain unauthorized access to any system, data, or account

- Post or transmit harmful, offensive, or infringing content of any kind

All content on this website, including text, images, and branding, is the intellectual property of Bohotides LLC and is protected under applicable copyright and trademark law. Unauthorized use may result in legal action.

3. Reservations and Payments

All bookings are subject to availability and must be confirmed in writing by Bohotides LLC before they are considered valid.

By completing a reservation, you agree to:

- Provide accurate, complete, and truthful guest information

- Pay all charges in full, including nightly rates, cleaning fees, taxes, and applicable service fees

- Comply with all property-specific house rules provided at the time of booking

Bohotides LLC reserves the right to refuse or cancel any reservation at our sole discretion, including reservations made by guests with prior violations of these Terms.

Payment is processed through a secure, PCI-DSS-compliant third-party processor. Bohotides LLC does not store credit card or payment data. You authorize Bohotides LLC to charge your payment method on file for any amounts owed under these Terms, including post-stay damage charges.

4. Cancellations and Refunds

Cancellation policies are displayed at the time of booking and vary by property and rate type. By completing your reservation, you accept the applicable cancellation policy in full.

No-shows and early departures are non-refundable unless otherwise stated in writing in your booking confirmation.

Bohotides LLC reserves the right to cancel any reservation due to property maintenance issues, safety concerns, force majeure events, or guest conduct that violates these Terms. In the event of a cancellation initiated by Bohotides LLC without cause attributable to the guest, a full refund will be issued. This refund shall constitute the sole remedy available to the guest and Bohotides LLC shall have no further liability.

5. Guest Responsibilities and Conduct

The lead guest who completes the booking is responsible for the conduct of all occupants and visitors during the stay.

You agree to:

- Comply with the maximum occupancy limit specified for the property at all times

- Not permit any person not listed on the reservation to stay overnight at the property

- Treat the property, furnishings, appliances, and outdoor spaces with reasonable care

- Abide by all local noise ordinances, neighborhood rules, and San Diego County short-term rental regulations

- Not use the property for commercial purposes, photoshoots, events, parties, or gatherings without prior written approval from Bohotides LLC

- Not smoke, vape, or use illegal substances anywhere on the property or premises

- Properly secure all doors, windows, and access points upon departure

- Report any damage, maintenance issues, or safety concerns to Bohotides LLC promptly

Violation of any of the above may result in immediate termination of the stay without refund and removal from the property.

6. Pool Use and Outdoor Areas

Use of the pool, hot tub, patio, and all outdoor areas is entirely at the guest's own risk.

By using these amenities, you acknowledge and agree that:

- Bohotides LLC is not responsible for any injury, accident, or death occurring in or around the pool or outdoor areas

- Guests assume full responsibility for supervising all children and non-swimmers at all times

- No lifeguard is on duty at any time

- Guests will not use the pool under the influence of alcohol or substances

- Guests will comply with all posted pool rules and safety guidelines

- Diving, running, or other unsafe conduct around the pool is strictly prohibited

- Pool use after designated quiet hours is prohibited

Bohotides LLC expressly disclaims all liability for injuries, accidents, or damages arising from pool or outdoor area use to the fullest extent permitted by California law.

7. Assumption of Risk

Guests acknowledge that short-term rental properties, including stairs, outdoor areas, pools, and surrounding terrain, carry inherent risks. By staying at a Bohotides property, you voluntarily assume all risks associated with the use of the property and its amenities.

Bohotides LLC shall not be held liable for any injury, illness, death, or loss of personal property arising during a guest's stay, except where directly caused by the proven gross negligence of Bohotides LLC.

8. Indemnification

You agree to indemnify, defend, and hold harmless Bohotides LLC and its owners, members, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

- Your use of the property or website

- Your violation of these Terms and Conditions

- Injury, damage, or loss caused by you, your guests, or your invitees during the stay

- Any unauthorized use of the property

- Any breach of applicable law by you or any member of your party

9. Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of Bohotides LLC for any claim arising from or related to a booking or stay shall not exceed the total amount paid by the guest for that booking.

Bohotides LLC shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind, including but not limited to loss of enjoyment, lost profits, or emotional distress.

Bohotides LLC is not liable for:

- Temporary service interruptions including internet outages, utility disruptions, appliance failures, or pool equipment downtime

- Loss, theft, or damage to guest personal property or vehicles

- Acts of third parties, neighbors, or service providers

- Conditions caused by weather, natural events, or circumstances beyond our reasonable control

- Allergic reactions, illness, or health conditions arising during a stay

Nothing in these Terms limits liability for death or personal injury caused directly by Bohotides LLC's proven gross negligence, or for fraud or fraudulent misrepresentation.

10. Property Condition and Accuracy

Bohotides LLC makes reasonable efforts to ensure property descriptions and photos are accurate at the time of listing. However, we do not warrant that listings are free of errors or that the property will meet every individual expectation.

Minor variations between listing descriptions and actual property conditions do not constitute grounds for a refund or cancellation outside of the stated cancellation policy.

11. Force Majeure

Bohotides LLC shall not be liable for any failure or delay in fulfilling obligations under these Terms caused by circumstances beyond our reasonable control, including but not limited to natural disasters, wildfires, flooding, power outages, government orders, public health emergencies, or acts of God. In such cases, Bohotides LLC will make reasonable efforts to notify affected guests and offer alternative arrangements or a credit where possible.

12. Damage and Additional Charges

Guests are financially responsible for any damage to the property, furnishings, appliances, linens, or outdoor areas caused during their stay beyond normal wear and tear.

By completing a booking, you authorize Bohotides LLC to charge the payment method on file for:

- Documented damage repair or replacement costs

- Excessive cleaning beyond standard turnover

- Unauthorized pet fees

- Unauthorized late check-out

- Any fines or citations issued to Bohotides LLC as a result of guest conduct

Bohotides LLC will provide documentation of any damage charges. Disputes must be submitted in writing within 7 days of the charge.

13. Check-In and Check-Out

Check-in and check-out times are specified in your booking confirmation. Early check-in or late check-out may be available upon request and is subject to availability and additional fees.

Guests who fail to vacate the property by the designated check-out time may be charged an additional nightly rate at our then-current pricing, plus any costs incurred from delayed turnovers.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed exclusively by the laws of the State of California. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts of San Diego County, California.

Before initiating any formal legal proceedings, both parties agree to make a good-faith effort to resolve disputes directly by contacting Bohotides LLC in writing at hello@bohotides.com.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with your booking confirmation and any property-specific house rules provided at the time of booking, constitute the entire agreement between you and Bohotides LLC and supersede all prior communications or agreements relating to your stay.

17. Modifications

Bohotides LLC reserves the right to update these Terms at any time. Changes take effect upon posting to this website. Continued use of the site or completion of a reservation following any update constitutes full acceptance of the revised Terms.
